3.1 Agreement to Terms

By accessing the NineOrigin website or placing an order, you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or purchase from us.

3.2 About NineOrigin & "Inspired By" Disclaimer

NineOrigin sells original fragrance compositions inspired by the scent profiles of well-known designer perfumes.

Our products are not genuine designer products and are not affiliated with, endorsed by, or connected to any designer brand in any way. All designer brand names referenced on this website are trademarks of their respective owners and are used purely to describe scent inspiration. NineOrigin does not sell counterfeit, replica, or imitation products.

3.3 Eligibility

By purchasing from NineOrigin, you confirm that:

  • You are at least 18 years of age

  • You are located in South Africa

  • You are legally capable of entering into a binding agreement

3.4 Products & Descriptions

We make every reasonable effort to accurately describe our products. However:

  • Fragrance scent perception is subjective and personal. Descriptions are guides only. What you experience may differ from the description, and this does not constitute a defect or grounds for a return.

  • Product images are representative. Minor packaging variations may occur between batches.

  • We reserve the right to discontinue any product without notice.

3.5 Pricing

  • All prices are displayed in South African Rand (ZAR).

  • NineOrigin is not currently VAT registered. No VAT is charged on our products.

  • Prices are subject to change without notice.

  • In the event of a pricing error on our website, NineOrigin reserves the right to cancel the affected order and offer a full refund, or fulfil the order at the corrected price with your consent.

3.6 Orders & Payment

  • An order confirmation email constitutes acceptance of your order. Until that confirmation is issued, no contract exists.

  • NineOrigin reserves the right to refuse or cancel any order at its discretion (e.g. suspected fraud, stock availability issues, pricing errors).

  • Full payment is required before any order is dispatched.

  • All transactions are processed by secure, third-party payment providers.

3.7 Shipping & Delivery

  • NineOrigin currently ships within South Africa only.

  • Delivery timeframes provided at checkout are estimates and are not guaranteed.

  • Risk and responsibility for goods transfers to the customer upon handover to the courier. NineOrigin is not liable for courier delays or losses after dispatch. In the event of a lost shipment, we will assist with the courier investigation but cannot guarantee outcomes.

3.8 Intellectual Property

All NineOrigin branding, content, product imagery, copy, and design elements are the intellectual property of NineOrigin. They may not be copied, reproduced, or distributed without prior written consent. Referenced designer trademarks remain the property of their respective owners.

3.9 Prohibited Use

You may not:

  • Use our website for any unlawful purpose

  • Attempt to gain unauthorised access to our systems

  • Submit false, misleading, or fraudulent information or orders

  • Resell NineOrigin products without prior written authorisation

  • Scrape or reproduce any part of our website without consent

3.10 Limitation of Liability

To the fullest extent permitted by South African law:

  • NineOrigin's liability to you for any claim arising from a purchase is limited to the amount paid for the specific order in question.

  • NineOrigin is not liable for indirect, consequential, or special losses of any kind.

  • NineOrigin accepts no liability for adverse reactions arising from misuse, failure to read the product label, or individual sensitivities to fragrance ingredients.

  • Nothing in these Terms excludes liability that cannot lawfully be excluded under the CPA.

3.11 Fragrance Safety

  • For external use only. Avoid contact with eyes.

  • Do not use if you have known fragrance allergies or sensitivities. A full ingredient list is available on request at info@nineorigin.co.za.

  • Keep out of reach of children.

  • Store in a cool, dry place away from direct sunlight.

3.12 Scent Accuracy Disclaimer

Our fragrance descriptions are provided in good faith based on scent family, notes, and inspiration. Scent is subjective. NineOrigin makes no guarantee that any fragrance will smell identical to, or to the same standard as, the designer fragrance it is inspired by. Dissatisfaction with scent does not constitute a defect, misrepresentation, or grounds for a refund.

3.13 Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts. We encourage you to contact us at info@nineorigin.co.za to resolve any issue informally before pursuing formal proceedings.

3.14 Changes to These Terms

We may revise these Terms at any time. The current version will always be published on our website. Continued use of our site following any changes constitutes acceptance.
